Luxury index registration

Terms and conditions of agreement for publication in Luxury Index:

1. 4yachting Company (hereinafter: "Company"), will do everything to the most of its power to publish the ordered advertisements (hereinafter: “Advertisements”) in Luxury Index (hereinafter “Magazine”) in terms and on the basis of approved by the Magazine texts in the same form, as they were provided according to the mentioned below conditions. The magazine reserves the right not to accept the advertisements for further publication.
2. A Client obligates to follow the terms and conditions of reservation and to pay to the Company the agreed in the order payment (hereinafter: “payment”) as an integral part of the order the VAT will be added according to the legislation.
3. In case of partly or total non-payment in the agreed terms, Magazine has the right to stop or postpone the publication of advertisements. Any delay in payment, partly or total, is to be paid by the Purchaser together with the percents regarding the payment total sum, which are defined by the bank of Israel for the disallowed payment delay. All the upper mentioned does not derogate the Company’s rights or its right for a help.
4. A Client has a right for reimbursement of payment, for not allowed for publication advertisements. If the advertisements are approved for publication, but were not published as agreed in the contract, Purchaser has a right for the repeated advertisement placement. A Client will not have a right and hereby refuses from any compensation and/or any other discharges from the Company or its representatives.
5. A Client confirms, that he was given an opportunity to read and to analyze the text advertisements in the form they were input into the company notes. Hereby a client refuses from all the claims, pretensions or actions against the Company or/and its representatives concerning the advertisements.
6. Company is not liable for the advertisements content and/or their intention, and/or their legal status and/or technical failure of advertisement and/or accuracy of details, Purchaser is wholly responsible for correctness of all the upper mentioned.
7. Purchaser obligates to take responsibility for Company and/or its representatives and/or any third party for any detriment or expenditures, caused to them as a result of advertisement publication or its content, and obligates to compensate for all the upper-mentioned on first demand.
8. Client does not acquire upon the terms of this agreement and/or advertisements other property rights or return right towards the Magazine or Company. Moreover, Client is not given a right to execute bilateral clearing in relation to Company.
9. Client is given 30 days without obligations and without advertisements payment. In case of non-cancellation and non-receiving of permit for cancellation from the Company, Client is charged in connection with this order.
10. Client confirms that he/she attentively read and understood all the terms of this agreement.
11. Signed below on behalf of Purchaser, confirms his/her authorities to charge the payment from Purchaser and with its signature obligates to incur personal liability for all Purchaser’s liabilities, and fulfill all the obligations, not excluding Purchaser’s liability.
12. The exclusive legal right to solve all the disputes, if any arise, between the parties regarding the terms and conditions of order, non-fulfillment or violation, particularly any question concerning advertisement, is to be given to the court of Israel.
